Insurers with a duty to defend will be glad to know that a state trial court in Pennsylvania recently rejected a policyholder’s demand that its insurer pay for independent counsel to defend the insured on the grounds of a purported conflict of interest. In so holding, the Court rejected the policyholder’s contention that the insurer’s issuance of a reservation of rights necessarily creates a conflict of interest for defense counsel retained by the insurer. read more.
