Our Environmental Law Practice Group delivers advanced litigation and counseling services to a broad range of clients including Fortune 500 companies, privately held businesses, local governments and individuals. The group handles matters involving international, federal and state environmental law enforcement, compliance and permitting for maritime and transportation industries; due diligence investigations and impact assessments for mergers, acquisitions and divestments; contaminated site and brownfield management and redevelopment; water quality, stormwater and wetlands; tanks; air emissions; alternative energy; indoor air quality; mold; agriculture; land development; toxic exposure and occupational health; mining; product registrations; genetically modified organisms; and waste disposal.

Our experienced team includes an ecologist and former U.S. Justice Department litigator, land development practitioners, and lawyers skilled in complex toxic tort cases, environmental due diligence for commercial transactions, and insurance coverage for environmental claims.

Marine and International Environmental Solutions

  1. Representation of international maritime shipping companies regarding TSCA issues and U.S. Environmental Protection Agency;
  2. Representation of international developer/borrower in preparing environmental due diligence and impact assessments in support of project finance and permitting in the Philippines, Estonia, India, El Salvador, and South Africa, securing over $300 million in project finance; and
  3. Representative of purchaser in environmental due diligence reviews for active manufacturing facilities in Canada and United States.

Real Estate Environmental Solutions

  1. Representation of land owner in an environmental compliance review of 85 domestic manufacturing facilities to support preparation of necessary Sarbanes/Oxley environmental reserve estimates and provide basis for comprehensive merger and acquisition due diligence;
  2. Defense of a PADEP enforcement action against a large agricultural operation in Pennsylvania;
  3. Representation of the owner/operator of a hazardous waste treatment and disposal facility in preparing a compliance plan integrating federal and state regulatory requirements;
  4. Preparation of a compliance plan and accompanying documents in support of commercialization of genetically engineered agricultural products; and
  5. Defense of landowner in PADEP enforcement action regarding leaking underground storage tanks on multiple sites.

General Environmental Law

  1. Defense of a Spill Act cleanup directive by NJDEP regarding a former dry cleaner site in New Jersey;
  2. Defense of a stormwater case against a large construction company in Pennsylvania; and
  3. Representation of a business concerning poor indoor air quality in Pennsylvania.
